3. Purpose and legal basis for processing your personal data
Which data of yours do we process? And for what purposes?
We process the data you have sent us in connection with your application in order to assess your suitability for the position (or any other open position in our company) and to complete the application process.
Recipients or categories of recipients Article 13 (1)(e) GDPR
We will not pass on your personal data to third parties unless this is necessary to fulfill legal obligations. Under certain circumstances, the data may be passed on to contract data processors (e.g. personnel consultants) and to persons who are obliged to maintain special confidentiality, such as lawyers.
To which recipients will the data be forwarded?
Your applicant data will be viewed by managers of SIMPAC Europe GmbH after receipt of your application. Suitable applications are then forwarded internally to the department heads for the respective open position. Then an agreement will be reached on the further procedure. As a matter of principle, only those persons within the company who need your data for the proper course of our application procedure have access to it.
What is the legal basis for this?
The legal basis for the processing of your personal data in this application procedure is primarily § 26 BDSG in the version valid from 25.05.2018 onward. It allows the processing of the data required in connection with the decision to establish an employment relationship. Should the data be necessary for the purposes of a legal prosecution after completion of the application procedure, data processing can be carried out on the basis of the requirements of Art. 6 GDPR, in particular to safeguard legitimate interests pursuant to Art. 6 (1)(f) GDPR. Our interest is then in the prosecution.
Duration of storage Article 13 (2)(a) GDPR
In the event of rejection, applicants' data will be deleted after 6 months at the latest. In the event that you have agreed to further storage of your personal data, we will transfer your data to our applicant pool. The data there will be deleted after two years at the latest.
What rights do you have with regard to your data?
In accordance with the GDPR, you have the right to obtain information about the origin, recipient and purpose of your stored personal data at any time and free of charge. You also have the right to request the correction, blocking or deletion of this data. You can contact us at any time at the address given in the imprint regarding this and other questions on the subject of data protection. Furthermore, you have the right to appeal to the competent supervisory authority.
You also have the right, under certain circumstances, to request that your personal data be restricted. Details on this can be found in the data protection declaration under "Right to restriction of processing".
If you assert your rights against us, we will process your personal data collected in this context to respond to your inquiry. Your personal data is processed to fulfill a legal obligation on the basis of Art. 6 (1)(1)(c) GDPR.
Right to lodge a complaint Article 13 (2)(d) GDPR
You have the right to complain to a supervisory authority about our processing of your personal data in the event that you believe a violation of the law has taken place.
